"Complying with State Taxes After South Dakota V. Wayfair"
Presented by Paul Lukasik, Managing Director, State and Local Tax, BDO USA, LLP and Ryan Hohenthaner, State and Local Tax Manager, BDO USA LLP

1 CPE Credit  Offered

On June 21, 2018, the Supreme Court of the United States issued its widely anticipated decision in South Dakota v. Wayfair, et al. No. 17-494.  In a 5-4 decision, the Court held that states may require a retailer to collect and remit sales taxes on sales of goods and services shipped or delivered to customers in states where the retailer has no in-state physical presence.

States are now empowered to impose their sales/use taxes and state income taxes on remote businesses, including retailers, online service providers, and licensors of software, that have no physical presence in a state.

Join our presenters as they discuss how the new nexus rules established by South Dakota’s law may affect businesses from a sales tax, income tax and accounting perspective.

Learning Objectives:
  • Understand states’ broadened authority to tax remote sellers as a result of Wayfair.
  • Understand business activities that trigger new state tax issues post-Wayfair.
  • Learn the Wayfair issues in industries and areas such as Retail, Technology, Manufacturing, Private Equity, and M&A.
  • Identify ways to mitigate historical tax liabilities.
  • Learn about potential GAAP issues post-Wayfair.

People who make themselves positively memorable are the ones who are most often hired, promoted, valued and positioned for opportunity.
